Court Administrative Order Now Requires Landlord-Petitioners to Advise of Pending CERAP Applications

On Aug. 13, 2021, the Chief Administrative Judge of the Courts of the State of New York issued Administrative Order AO/244/21 to assist in the implementation of the statewide New York Emergency Rental Assistance Program (CERAP), set up to provide rent relief in response to the COVID-19 pandemic. Effective Aug. 13, 2021, landlord-petitioners in court proceedings who have either been notified of a pending application for emergency rental assistance by a tenant, or who have applied for emergency rental assistance on behalf of a respondent-tenant and have an application pending, or have received emergency rental assistance on behalf of a respondent-tenant, must submit notice to the court in which an eviction proceeding is pending. AO/244/21 remains in effect for as long as the federal/state ERAP program remains in effect. The Administrative Order includes a form for use in notifying the court of a pending or completed rental assistance application.
