Administrative Order 34 of 2022 Addresses Court Procedures Post-Eviction Moratorium
LVT Number: #31816
Immediately following the end of the NY eviction moratorium on Jan. 15, 2022, the NY Court System issued AO/34/22 on Jan. 15, 2022. This order provides that all residential eviction proceedings will resume and remain subject to conference requirements. Also, motions to the court are required for warrant applications for judgments issued between March 17, 2020, and Sept. 1, 2021. No default judgments will be issued without a motion. Proceedings may be conducted remotely or in person "as appropriate." The AO notes that ERAP applications still stay eviction proceedings until a final determination is made on the tenant's application. However, ERAP doesn't apply to stay cases involving nuisance behavior or property damage. The Court also issued a Memorandum providing further guidance, found at LVT #31815.
