Tenant complained of a rent overcharge. The DRA ruled for tenant. Among other things, the DRA disallowed from the 1/40th improvement costs the cost of ceramic tiles installed in the apartment. Landlord appealed and won. Landlord was entitled to a rent increase based on the $1,500 cost of the tiles, as well as the related $600 demolition expense.
