Tile Work Performed by Super

Tenant complained that his first stabilized rent was higher than the fair market rent. Landlord submitted proof of extensive apartment renovations made before tenant moved in. The DRA ruled for tenant. Among other things, the DRA disallowed the cost of tile work done by the building superintendent as part of the renovation. Landlord appealed, and the DHCR ruled for landlord. Landlord had adequately proved this expense with a bill and canceled checks. The super was paid separately for this work; he didn't do it as part of his regular salary.
