Carbon Monoxide Detectors

The City of Yonkers requires landlords to comply with Local Law 4 of 2001 by installing carbon monoxide (CO) detectors. Landlord asked the DHCR how it could get rent increases to cover the cost of the installation. In an opinion letter, the DHCR said that landlord could collect the cost through a 1/40th individual apartment improvement increase. For vacant apartments, the 1/40th cost could just be added to the next tenant's legal rent. For occupied apartments, tenant's written consent is usually required for a 1/40th rent increase.
