Building Qualified as ‘Rooming House'

Tenant complained of a rent overcharge. The DRA ruled for tenant, finding that the building was a rooming house subject to hotel stabilization. For the period in question, there was a 0% guideline increase allowable. So landlord had collected a rent overcharge. Landlord appealed. The DHCR ruled against landlord. Landlord admitted that tenant's apartment didn't contain a bathroom. It had to be entered from the hall and there were fewer than 30 sleeping rooms in the building. So the building was a rooming house subject to hotel guidelines.
