Boiler Requires Registration, Even Before Gas Is Turned On

DEP issued a violation notice to landlord for installing a boiler and hot-water heater without first registering the equipment. Landlord argued that no permit was yet required because the gas wasn't turned on until two months after the violation was issued. The ALJ ruled against landlord and fined it $700. Landlord appealed and lost. The installed equipment required a registration, even if the equipment wasn't in operation yet.
