Balcony and Terrace Reconstruction Were Part of Facade Work

The DRA granted landlord's application for MCI rent hikes based on facade work and accompanying architect services. Tenants appealed and lost. Tenants argued that no MCI increase should be granted for balcony/terrace work since most tenants didn't have those apartment features and didn't benefit from the improvement. The DHCR disagreed, noting that removal of deteriorated concrete and the reconstruction and restoration of facade balconies was part of facade restoration needed to maintain a watertight condition and protect the structural integrity of the building as a whole.
