Back Rent Owed Exceeds Overcharge Amount

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed, claiming that tenant had moved out and owed landlord $9,740 in back rent. The DHCR ruled for landlord. The amount of back rent was more than the overcharge, so the DHCR revoked the overcharge finding. The DHCR ruled also that if tenant had moved out, the back rent should be paid immediately. If tenant still lived in the apartment, tenant could pay the back rent in 24 equal monthly payments.
