15% Increase for New Boiler/Burner

Yonkers landlord applied for an MCI rent hike based on the installation of a new boiler/burner. Tenants claimed that the boiler/burner shouldn't qualify for an MCI rent hike because it's required for the operation and maintenance of the building. The DRA granted a 15 percent rent hike, and tenants appealed. The DHCR ruled for landlord. The old boiler/burner frequently broke down, leading to numerous DOB violations. So replacing it qualifies for an MCI rent hike.
