Windows Difficult to Close

Tenant complained of a reduction in required services because new windows in his apartment were difficult to close. Landlord claimed that the new windows were installed according to the manufacturer's specifications and in compliance with all applicable laws and regulations. An inspection showed that the windows throughout the apartment were difficult to close. The DRA ruled for tenant and reduced his rent. Landlord appealed. The DHCR ruled against landlord. Landlord submitted no documents or statements from its contractor, an engineer, or other qualified personnel to prove that the windows were closing properly.
