Was Five-Family Building Improperly Converted to 16-Unit SRO?

DOB issued a violation notice to landlord for building occupancy contrary to the Certificate of Occupancy (C of O). DOB's inspector found that, although the C of O listed one store and five family units, the building contained 16 SRO units and was operated as a hotel. The ALJ dismissed the violation, finding that its language was conclusory and therefore defective. The DOB appealed, and the case was reopened. The violation notice identified the section of law charged and the essential elements of the violation. ECB ordered a new hearing to be held before an ALJ.
