Violation Notice Properly Delivered to Landlord at Known Address

DOB issued a violation notice to landlord for altering a two-family dwelling into a three-family dwelling in violation of the building's Certificate of Occupancy. DOB's inspector observed an additional Class "A" apartment on the building's first floor, with full kitchen and bathroom. Landlord denied making the alterations, claiming that the second apartment was there when he bought the building. He also claimed that he started to correct the condition as soon as he learned the apartment was illegal. The ALJ ruled against landlord and fined him $1,600.

DOB left a copy of the violation at the building and mailed a second copy to landlord at the building. Landlord claimed that he had another address, but this address didn't appear in DOB, HPD, or DOF records. So DOB wasn't required to make an additional mailing.
