Violation Notice Not Sent to Alternative Address

LVT Number: 11777

DOB issued a violation notice to landlord for not maintaining the elevator. Landlord claimed the notice was improperly addressed to ``916 Union Street Corp.'' instead of to ``916 Union Street Apartments Inc.'' and should therefore be dismissed. The ALJ ruled against landlord and fined it $200. Landlord appealed and pointed out that the city charter required that a second copy of the violation notice be mailed to landlord's other address, which was on file with HPD. Since this wasn't done, landlord claimed the violation should be dismissed. ECB ruled for landlord and revoked the fine.
