Violation Notice Didn't State Date of Occurrence

Fire Department issued a violation notice to landlord for not conducting a required test of the elevator system and elevator recall. Landlord produced a letter from its elevator contractor dated Feb. 18, 1994, stating that the elevators were properly functioning. Landlord noted that the violation notice didn't state when the supposed violation occurred. The ALJ ruled against landlord and fined him $400. Landlord appealed. ECB ruled for landlord and revoked the fine. ECB policy requires that the date of occurrence must always be stated on landlord's copy of a violation notice.
