Violation Improperly Issued on Collection Day

DOS issued a violation notice to landlord for leaving trash out at the curb. Landlord argued that the trash was properly left out for collection on a normal garbage collection day. The ALJ ruled against landlord, and fined landlord $50. Landlord appealed. This time, landlord submitted a supporting letter from a City Council member, and DOS admitted that the violation notice was improperly issued on a regular trash collection day. ECB ruled for landlord.
