Violation Corrected Before Hearing Date

The Fire Department issued a violation notice to landlord for not maintaining a fireproof self-closing door to the boiler room. The door was off its hinges. The violation notice was dated 12/2/94, the certification date was 1/6/95, and the scheduled hearing date was 1/17/95. Landlord claimed the violation was corrected by the hearing date. The ALJ ruled against landlord and fined him $450. Landlord appealed. ECB ruled for landlord and reduced the penalty to $150. Landlord showed proof that the door was fixed before the 1/17/95 hearing date.
