Landlord applied for MCI rent hikes based on the installation of a new boiler/oil burner. Landlord stated that the old unit was 10 years old. The DRA ruled against landlord because the useful life of the old equipment hadn't expired. Landlord appealed and lost. Under the DHCR's useful life schedule, the useful life of a boiler is 25 years, and the useful life of a burner is 20 years. Landlord admitted its items were only 10 years old when replaced. And landlord didn't apply to the DHCR for a useful-life waiver before fiing its MCI application.
