Useful Life of Hot-Water Heater Expired

Landlord applied for MCI rent hikes based on the installation of two hot-water heaters. The DRA ruled against landlord, finding that the useful life of the old water heaters hadn't expired. Landlord appealed. The useful life of hot-water heaters that aren't connected with central heating is 10 years. Although landlord's prior MCI rent hike for hot-water heaters was granted in 1993, the installation was done in 1990, which was 12 years before the new hot-water heaters were installed. The DHCR ruled for landlord and granted the rent hike.
