The DOB issued landlord two violation notices that named ''Jorgenson J Galano R'' as landlord. Landlord argued that the notices were defective because they named two respondents. Landlord also pointed out that R. Jorgenson and J. Galano are two individuals who own the building through a corporation. The ALJ dismissed the violations, finding that the corporation didn't get proper notice. The DOB appealed, arguing that this was a harmless mistake, based on Department of Finance records. The ECB ruled for landlord.
