Two-Inch Crack in Wall

DOB issued a violation notice to landlord for not maintaining its building in a safe condition, based on a two-inch structural crack in the front foundation wall between the sidewalk vault and the cellar. Landlord claimed the same crack had been reported eight months earlier and had been fixed shortly thereafter. The ALJ found landlord's proof insufficient and fined it $800. Landlord appealed. Landlord's managing agent claimed the crack had been fixed. But this employee didn't start working for landlord until two months after the second inspection. ECB ruled against landlord.
