Tenant complained of a reduction in services based on insufficient janitorial services. The DRA ruled for tenant. Landlord appealed, arguing that the trash was picked up twice a week and that tenants didn't put their trash out properly. The DHCR ruled against landlord. The DHCR's inspector found garbage odors and trash accumulation in the basement, lobby, and hallways of the building. Landlord had a duty to maintain the building's public areas. It didn't matter what caused the filthy building condition. Collecting trash only twice a week clearly wasn't enough.
