Landlord sued to evict Westchester tenant for nonpayment of rent. The trial court ruled for landlord, and tenant appealed. Tenant claimed improper service of the three-day notice. The appeals court ruled for tenant. The three-day notice was sent by certified mail only. This was a violation of service requirements under applicable law. Landlord's petition was dismissed.
