Tenants Who Appeal Order Needn't Pay Retroactive Increase

Landlord asked the DHCR about the effect on building-wide rent increases when one tenant files a PAR objecting to MCI rent increases. In an opinion letter, the DHCR stated that if only one tenant files a PAR against an MCI order, the PAR stays only the retroactive rent increase applicable to tenant's apartment. No other tenants' rents are affected. Similarly, if a tenant association files a PAR against the MCI increase and 40 out of 100 tenants join the PAR, only the retroactive rent increases of those 40 tenants are delayed while the PAR is pending.
