Tenants Unaffected by New Elevators in Neighboring Building

Landlord of two adjacent buildings applied for MCI rent hikes, based on upgrading the elevator. Tenant challenged landlord's application, claiming that he lived in a three-story walk-up building and that the upgraded elevator was in an adjacent building. The DRA ignored tenant's argument and granted landlord's application. Tenant appealed, arguing that he couldn't benefit from the elevator work. Tenant wins. An inspection confirmed that tenant's walk-up apartment was in a three-story building that didn't connect in any way to the neighboring building with the elevator.
