Tenant's Medical Condition No Defense

LVT Number: #24132

Landlord sued to evict rent-stabilized tenant for nonprimary residence. The trial court ruled for landlord. Tenant appealed and lost. Tenant claimed that, after a January 2005 car accident, he had problems walking and stayed at a New Jersey residence to recuperate. But landlord presented strong documentary evidence of nonprimary residence and tenant testified that his condition had improved and that he had become more self-sufficient since the accident. The trial court also didn't find tenant credible.
