Tenants of Loft Building Covered

Landlord sued to eject residential tenants from commercial loft buildings. Landlord claimed that tenants lived illegally in the commercial units. Tenants pointed out that there was a prior ruling that the buildings were, in fact, a horizontal multiple dwelling and that tenants could qualify for rent stabilization coverage. Tenants weren't covered by the Loft Law. The court ruled for tenants. Landlord had admitted in 1997 that it was aware that tenants lived in the buildings. And even though tenants' rents were over $2,000 per month, high-rent deregulation didn't apply because no legal regulated rents had been set by the DHCR.
