Tenant's Granddaughter Paid Back Rent Owed
LVT Number: #27263
Landlord sued to evict tenant for nonpayment of rent. The court ruled for landlord based on tenant’s failure to appear in court. Tenant’s granddaughter then asked the court to either vacate the judgment and warrant or extend the stay of execution of the warrant. The court ruled for the granddaughter on condition that rent payments be made. Landlord objected and had rejected HRA and DSS checks because the granddaughter wasn’t the tenant of record. The court ruled against landlord, vacated the judgment and warrant, and dismissed the case. Tenant’s granddaughter appeared repeatedly in court in this case over a six-month period without objection from landlord, and landlord didn’t appeal any prior court orders. The granddaughter offered full payment of the rent due.
