Tenant's Granddaughter Gets Renewal Lease

LVT Number: 14510

Tenant's granddaughter complained that landlord wouldn't give her a rent-stabilized renewal lease in 1994. Tenant had died in 1992, and the granddaughter signed a renewal lease that year, even though the lease was in tenant's name. In 1994 landlord refused to give the granddaughter a renewal lease, but instead gave her a one-year sublease. Landlord claimed that the granddaughter hadn't proved pass-on rights. The DRA ruled for landlord in part, finding that the granddaughter hadn't proved pass-on rights, but ordering landlord to give her a rent-stabilized vacancy lease.

Both landlord and granddaughter appealed. The DHCR ruled for granddaughter. She had submitted sufficient documentary proof that she had lived in the apartment with tenant for at least two years before tenant died and was entitled to a renewal lease.
