Tenant's Daughter Gets Rent-Stabilized Apartment
LVT Number: #24410
Rent-stabilized tenant's daughter claimed succession rights after tenant died, and complained to the DHCR that landlord refused to give her a renewal lease in her own name. The DRA ruled for the daughter. Landlord appealed and lost. Landlord didn't file an answer to the complaint and couldn't raise new evidence for the first time on appeal. In addition, the daughter showed that she lived in the apartment for two years before tenant died, by submitting copies of income tax returns and related documents for 2006 and 2007, a college transcript for 2006, a pay stub from 2006, two cable television bills from 2007, three statements for unemployment insurance from 2008, and a copy of her daughter's school records.
