Tenant Withdrew Complaint Against Current Landlord

Tenant complained of a rent overcharge in February 1984. Tenant later stated that he was withdrawing the complaint against new landlord. The DRA dismissed tenant's complaint on the basis of the settlement. Tenant appealed, pointing out that he hadn't withdrawn his complaint against prior landlord who owned the building until September 1982. The DHCR reopened the case and ruled for tenant. The DRA found there was an overcharge from March 1980 through September 1984. Some of the overcharge determined was during the period new landlord owned the building. New landlord appealed. The DHCR ruled for landlord. Before the DRA's order was issued, tenant withdrew his complaint against new landlord. The overcharge finding was reduced to cover the period from March 1980 through September 1982 only.
