Tenant Wasn't Primary Resident
LVT Number: 10656
(Decision submitted by Peter A. Schwartz of the Manhattan law firm of Fromme Fromme Schwartz & Cornicello, LLP, attorneys for the landlord.) Rent-stabilized tenant complained of a reduction in services. The DRA ruled for tenant and reduced her rent. Landlord appealed. Landlord had sued to evict tenant for nonprimary residence. The court had ruled in landlord's favor before the DRA's order was issued. The DHCR ruled for landlord and revoked the rent reduction. Possession of the apartment had been awarded to landlord, and tenant had moved out before the DRA's order was issued.
