Tenant Unaffected by Rent Cut Order

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. The DRA had found that tenant's rent should have been reduced by a prior DHCR order cutting rents based on a reduction in building-wide services. But, as landlord pointed out, tenant wasn't affected by that rent cut. It applied only to tenants who had to move out temporarily because of a building fire. The DHCR ruled for landlord.
