Tenant Rent Controlled Due to CAB Expulsion Order
LVT Number: 19223
Landlord asked the DHCR to determine tenant's status. Tenant claimed that she was rent controlled. Landlord said tenant was rent stabilized. The DRA said tenant was rent controlled. Landlord appealed and lost. In 1982, the CAB issued an order terminating landlord's membership in the Rent Stabilization Association and, as a penalty, placed tenant's apartment under rent control. Since no subsequent DHCR order had revoked the CAB's decision, tenant's apartment remains rent controlled.
