Tenant Refuses to Sign Renewal Lease Containing Improper Conditions

Landlord sued to evict rent-stabilized tenant, claiming that tenant failed to sign a renewal lease before tenant's current lease ended. Tenant argued that the renewal lease offered was unlawful. The court ruled against landlord because the renewal lease offered was conditioned on payment of $18,000 in back rent that landlord claimed was owed. Landlord can't evict tenant based on tenant's refusal to sign a renewal lease that contained an illegal rent.
