Tenant Refused to Sign Renewal Lease

Landlord sued to evict tenant for failing to sign a rent-stabilized renewal lease. Tenant asked the court to dismiss the case without a trial. The court ruled for tenant. Landlord appealed, and the court reopened the case. Before deciding whether the renewal lease offer was proper, the court must determine whether the rent amount stated in the renewal lease was legal. To do so, it must determine the lawful base date rent.
