Landlord sued to evict rent-stabilized tenant for nonprimary residence. The court ruled against landlord. Landlord appealed and lost. The trial court had evaluated the entire history of the tenancy, dating back to 1971, and had fairly evaluated the evidence in determining that tenant primarily resided in the apartment.
