Tenant Must Pay Use and Occupancy While Case Pending

(Decision submitted by Sabrina B. Isaacs of the Manhattan law firm of Kucker Kraus & Bruh, LLP, attorneys for the landlord.) Landlord sued to evict rent-stabilized tenant for illegal subletting. Landlord asked the court to direct payment of use and occupancy while the case was pending. The court ruled for landlord. There was no reason why landlord shouldn't receive use and occupancy while the case was pending to preserve the status quo. Tenant was ordered to pay all past u&o within two weeks, and to pay u&o in the future by the tenth day of the month.
