Tenant Moved to Different Apartment in Same Building

Tenant complained that the rent landlord charged her when she moved to a different apartment in the same building constituted a rent overcharge. Landlord claimed that it could charge tenant the same rent for the new apartment as she'd been charged for her first apartment. The DRA ruled for tenant and found a willful rent overcharge. Landlord appealed. The DHCR ruled against landlord. Landlord charged tenant a monthly rent of $460 for the new apartment. The legal rent was $290.
