Tenant Lived in Other Apartment

Landlord sued to evict rent-controlled tenant for nonprimary residence. The court ruled for landlord after a jury trial, and tenant appealed and lost. There was overwhelming proof that tenant illegally sublet the apartment to a series of subtenants at a much higher rent. Landlord also showed that tenant lived in another building. Tenant claimed he had roommates in the rent-controlled apartment and that his adult children lived in the other apartment. But the jury obviously didn't believe that testimony. Landlord's superintendent and investigator stated otherwise.
