Landlord sued to evict tenant for nonpayment of rent. The court granted tenant's request for a brief adjournment and didn't order tenant to pay use and occupancy in the meantime. Landlord appealed. The appeals court ruled against landlord. The trial court had the discretion to grant the adjournment and didn't violate the law or abuse its discretion in doing so.
