Tenant Gets Rent Abatement for Apartment Conditions

Landlord sued to evict rent-stabilized tenant for nonpayment of rent. Tenant claimed breach of the warranty of habitability. The court ruled for tenant in part. From August through November 2014 there were rent-impairing conditions, including mice and roach infestations that the landlord had notice of. The court awarded tenant a total rent abatement of $687 and gave landlord a judgment of $4,312 for rent due through May 2015. The rent abatement granted was 10 percent for three months and 15 percent for two months.
