Tenant Gets $49,470 in Attorney's Fees
LVT Number: #25226
Rent-stabilized tenant sought additional attorney's fees after successfully defending against landlord's appeals of a lower court's order. The court ruled for tenant and awarded a judgment for $49,470. Landlord had sued tenant for nonpayment of rent. The court ruled against landlord and awarded tenant $24,250 for breach of warranty of habitability and contempt. The court also found that landlord committed fraud by registering a fictitious tenant to illegally and falsely inflate tenant's rent. Landlord lost several appeals. The attorney's fee award was based on the ultimate outcome of the case and the court's finding that landlord's appeals were frivolous.
