Tenant Didn't Show Need for Pretrial Questioning
LVT Number: #19828
(Decision submitted by Edward P. Alper of the Manhattan law firm of Kucker & Bruh, LLP, attorneys for the landlord.) Landlord sued to evict rent-stabilized tenant for nonprimary residence. Tenant asked the court for permission to conduct pretrial questioning of landlord's employees. The court ruled against tenant. To get pretrial discovery in a summary proceeding, landlord or tenant must show ample need. In this case, tenant didn't show what information it sought to obtain from the two named employees.
