Tenant Didn't Prove Heat Complaint with HPD Violation

Rent-stabilized tenant complained of inadequate heat in her apartment. The DRA ruled for tenant and reduced her rent. Landlord appealed and won. Landlord argued that no violation had been issued by any other agency confirming a lack of heat in tenant's apartment. The DHCR agreed. Tenant failed to provide a report from an appropriate agency confirming the existence of the heat condition she complained about. There was no corroborating report from HPD of a violation relating to heat or hot water. So the rent reduction order was revoked. [Download decision here.]
