Tenant Didn't Complain About Conditions Cited

Tenant complained of reduced services in her apartment. The DRA ruled for tenant, and landlord appealed. Tenant had complained about her bathroom ceiling, no cold water in the kitchen, and a broken hot water faucet. An inspection showed instead peeling paint and plaster throughout the apartment and inadequate water pressure. Tenant hadn't complained about these conditions. Since landlord had no notice of these conditions from tenant's complaint, it was improper to reduce tenant's rent. The DHCR ruled for landlord and revoked the rent cut.
