Tenant Didn't Attend Hearing
LVT Number: 9866
Landlord sued to evict tenant for nonpayment of rent in Manhattan court. The court ruled for landlord and ordered a hearing on the amount of attorney's fees to be awarded landlord. The judge in the case was transferred to Brooklyn before the hearing, so the hearing was scheduled there. Tenant refused to attend the hearing in Brooklyn. Afterwards, tenant appealed the fee award to landlord. The appeals court ruled against tenant. Tenant hadn't objected to the Brooklyn hearing location before the hearing date. The hearing was conducted in NYC Civil Court by a housing court judge. It didn't matter that this part of the case was heard in a different county.
