Tenant Deregulated When Building's J-51 Benefits Ended

Tenant complained of a rent overcharge. He also complained that landlord refused to give him a rent-stabilized renewal lease. Instead, landlord gave tenant a free-market lease. The DRA ruled against tenant. Tenant appealed and lost. Tenant's prior leases clearly notified him that his rent-stabilization status ended on June 30, 2001, when landlord's tax benefits expired. Landlord was free at that point to enter into a market-rent lease with tenant.
