Tenant Created Dirty Hallway Condition

Tenant complained of a reduction in building-wide services. Tenant claimed that the building hallway was filthy. An inspection showed that there was an accumulation of furniture, garbage, and a refrigerator on the top floor. The DRA ruled for tenant and reduced the rents of all rent-controlled tenants in the building. Landlord appealed, claiming that the hallway conditions were created by complaining tenant. The DHCR ruled for landlord. The hallways on the other floors were clean, and there was proof that tenant left the debris out in the hallway. The rent reduction was revoked.
