Tenant Claims He's Rent-Controlled Based on Succession Claim

Rent-stabilized tenant complained that his mother had been the apartment’s rent-controlled tenant, that he had succession rights, and that therefore he should be rent controlled instead of rent stabilized. The DRA ruled for tenant. Landlord appealed and won. Tenant didn’t prove that he occupied the apartment as a primary residence during the two-year look-back period, from November 1987 to November 1989, before rent-controlled tenant died. Tenant had signed a rent-stabilized lease for the apartment in 1993, and remained a rent-stabilized tenant.
